Terms of Service

1. Agreement

By creating a Forgekite account or using the Forgekite service (“Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. Forgekite is operated by Peakure LLC.

2. The Service

Forgekite provides AI-powered software that helps businesses send automated payment reminders to overdue debtors. You remain the sender of all communications — Forgekite acts as your agent, not as an independent debt collector.

3. Eligible use

You may use Forgekite only to collect business-to-business (B2B) debts owed to you for goods or services you provided. You may not use Forgekite to:

  • Contact consumers (individuals) for personal debts — this is regulated by the FDCPA and state debt collection laws.
  • Send harassing, abusive, or threatening communications.
  • Misrepresent your identity or the amount owed.
  • Contact debtors who have ceased contact or retained legal counsel, if you are aware of this.
  • Send SMS messages without prior express written consent from the recipient.

4. Your responsibilities

  • You are responsible for ensuring that all debts you submit to Forgekite are valid, accurate, and legally collectable.
  • You are responsible for compliance with all applicable laws in your jurisdiction, including the Fair Debt Collection Practices Act (FDCPA), the Telephone Consumer Protection Act (TCPA), CAN-SPAM, GDPR, and CCPA.
  • For SMS escalations, you must obtain and maintain records of prior express written consent from each debtor before enabling SMS for that contact.
  • You must not share your account credentials with unauthorized parties.

5. Subscription and billing

  • Forgekite is billed monthly or annually via Stripe. Your subscription renews automatically.
  • You may cancel at any time. Cancellation takes effect at the end of your current billing period — no refunds for partial periods.
  • We reserve the right to change pricing with 30 days' notice. Existing subscriptions are grandfathered for the current billing period.
  • Failed payments will result in account suspension after a 7-day grace period.

6. AI-generated content

Forgekite uses AI to generate collection reminder messages. You review and approve the tone settings and escalation schedule. You remain legally responsible for all communications sent from your account. Forgekite does not guarantee that AI-generated messages will be effective in recovering payment.

7. Intellectual property

Forgekite and its underlying technology are owned by Peakure LLC. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription. You retain ownership of all data you upload to Forgekite.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGEKITE AND PEAKURE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Peakure LLC and its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

10. Termination

We may suspend or terminate your account immediately if you violate these Terms. You may terminate your account at any time via the billing portal or by emailing team@forgekite.com.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Suffolk County, Massachusetts.

12. Changes

We may update these Terms. We will notify you by email 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance.
